BUYING A HOUSE OR LAND

When you are buying a house or land APT Conveyancing can take care of all your home loan and conveyancing needs including:

* Examine the Contract of Sale and the Section 32

* Help you find a home loan or liase with your lending institution or Mortgage Broker

Before buying a house you should first read the Section 32 which you can collect from your Real Estate Agent. This document contains all the relevant information in relation to the property and transferring the title to the property. A property cannot be sold unless a Section 32 is signed by the Vendor. Before you sign the Contract of Sale you must ensure that you identify the property from the Section 32 and determine the availability of services eg. electricity, water, gas. Once you have signed the Contract of Sale your Real Estate Agent will forward it to APT Conveyancing.

If your contract of sale is subject to finance APT Conveyancing will act on your behalf with any information required by your lending institution in regards to you getting a home loan. Once you have finance approval (if applicable) and you have paid your deposit we will start the transfer of land process.

APT Conveyancing will confirm that the Section 32 has been completed correctly and that any conditions noted on the Contract of Sale have been satisfied. Once we determine that all conditions have been met we will liase with the Vendor's Conveyancer concerning any requisitions on the title. When the reply is received we know all is ready for transferring the title to your property at settlement. We will than forward you a Transfer of Land contract. Once signed, we will forward the Transfer of Land contract to the Vendor's Conveyancer for signing by the Vendor. At this stage, we will also forward all relevant documents to your mortgage broker or lending institution so they can prepare the mortgage documents.

Once the Transfer of Land contract has been finalised we will prepare a Statement of Adjustments. This allows us to ascertain that the Council Rates, Water Rates and Body Corporate fees (if applicable) are fully paid until the end of the financial year. It also includes a breakdown as to where all the funds are to be paid. A Notice of Acquisition will be prepared to notify the Local Council and Water Authority that you will take possession of the property upon settlement.

APT Conveyancing will organise a settlement date with all the relevant parties and will attend settlement on your behalf. Settlement will involve transferring the title to your property and, once successful, we will contact you to collect your keys from your Real Estate Agent.
