SELLING YOUR HOUSE OR LAND

Once you have decided upon selling your house you will need a Section 32 prepared, also known as a Vendor's Statement. Your Real Estate Agent cannot sell your property without it. The Section 32 contains information such as Local Council Rates, Water Rates, building certificates and roads. Whether you are auctioning your house or if it is a private sale will determine the type and amount of information contained in the Section 32. APT Conveyancing can prepare your Section 32 and, if you are auctioning your house, arrange for a Contract of Sale to be prepared. The Section 32 will then be handed to your Real Estate Agent for potential buyers to peruse before signing the Contract of Sale.

Once the property is sold the purchaser will sign the Contract of Sale and it will be forwarded to APT Conveyancing. The purchaser will then have two weeks to pay the deposit in full. At this time the Contract of Sale will become unconditional.

Normally the deposit will be held in trust by your Real Estate Agent until settlement. APT Conveyancing may be able to organise an early release of this deposit by preparing a Section 27. If the purchaser and their conveyancer agree to an early release of the deposit the vendor is entitled to the deposit within 28 days from signing the Contract of Sale. If you require us to complete a Section 27 please contact APT Conveyancing as soon as the Contract of Sale has been signed to enable us to compile the required information.

The purchaser's conveyancer will usually ask a series of questions called requisitions on title. APT Conveyancing will answer these questions on your behalf to ensure there are no hiccups in the transfer of property.

We will arrange a Discharge of mortgage and determine a payout figure for your mortgage from your lending institution. This enables transferring the title to your property to be achieved at settlement.

When the signed Transfer of Land contract is received from the purchaser's conveyancer we will prepare a Statuary Declaration of Chattels. This document is required to confirm the purchase price so the correct amount of Stamp Duty is paid. Both the Transfer of Land contract and the Statuary Declaration of Chattels will be forwarded to you for signing.

Shortly before settlement we will receive a Statement of Adjustments from the purchaser's conveyancer. This ensures that your local council rates and water rates are paid up until settlement date and the purchaser will pay for the rest of the charging period.

APT Conveyancing will attend settlement on your behalf. Once settlement is complete and the transfer of property has been finalised we will contact you to let you know everything has been completed satisfactorily.

After settlement a Notice of Disposition will be sent to your Local Council and Water Authority. If a Section 27 has not been arranged you can collect your deposit from your Real Estate Agent less their commission.
